What this site is

These terms govern your relationship with us. The marketplace rules govern your relationship with the other member, and both apply to every trade.

Buy Used Cameras is a marketplace where private individuals list used camera and photographic equipment for sale. We are not a retailer. We do not own, hold, inspect, test or ship the items listed here.

We are not a party to transactions between members. When you buy from someone here, your contract is with that person, not with us.

What we actually check

Being precise about this matters more than sounding impressive. We:

• Require every seller to confirm an email address and a phone number that is not an internet line.
• Require a proof of ownership photograph showing the item beside a handwritten note with the seller name and date.
• Require and record the serial number on cameras and lenses, and check it against our watchlist.
• Review listings from unverified sellers before they publish.
• Offer an identity check through a third party provider, and badge sellers who pass.

We do not physically inspect items, test their function, or guarantee their condition, authenticity, legal title or fitness for purpose. Our checks reduce risk. They do not eliminate it.

Your account

You must be 18 or older and provide accurate information. One account per person. You are responsible for keeping your password secure and for everything done through your account.

We may suspend or close an account that breaks these terms, that we reasonably believe is being used fraudulently, or that puts other members at risk.

Listing rules

You may only list items you own and are legally entitled to sell. You must describe condition and faults honestly, use your own photographs of the actual item, and price in good faith.

Prohibited: stolen goods, counterfeits, items you do not have in your possession, stock or borrowed photographs, misleading condition claims, and any attempt to move a transaction off site to avoid our protections.

We may remove any listing at our discretion.

Payment between members

At present, payment is arranged directly between buyer and seller. We strongly recommend PayPal Goods and Services because it carries buyer protection on private party sales. Never send a bank transfer, gift card, cryptocurrency or Friends and Family payment for goods you have not received.

We do not hold, process or escrow member funds today. If that changes, these terms will be updated and you will be told before it takes effect.

Our fees

Browsing is free. Seller memberships, listing upgrades and featured placements are charged as shown at the point of purchase. Fees for these services are non refundable once the service has been delivered, except where the law says otherwise.

Disputes between members

If a trade goes wrong, contact the other member first. If that fails, report it to us and we will investigate, which may include removing listings, applying badges, or closing accounts. We can act on our own platform, but we cannot compel a refund or recover goods, and we are not an arbitrator.

Use the buyer protection offered by your payment method. That is the mechanism that gets money back.

Limitation of liability

To the fullest extent permitted by law, we are not liable for losses arising from transactions between members, from the condition, authenticity or legality of items listed, or from any member failing to do what they promised.

Nothing here excludes liability that cannot lawfully be excluded.

Content you post

You keep ownership of your photographs and text. You grant us a licence to display, resize and reproduce them for the purpose of running and promoting the marketplace. You confirm you have the right to grant that licence.

Trademarks

Canon, Nikon, Sony, Fujifilm, Panasonic, OM System, Pentax, Leica, Hasselblad, Blackmagic Design, Sigma, Tamron and all other brand and product names belong to their respective owners and are used here purely to identify equipment. We are not affiliated with, endorsed by, or sponsored by any manufacturer.

Changes and governing law

We may update these terms. Material changes will be notified to registered members before taking effect, and continuing to use the site after that constitutes acceptance.

These terms are governed by the laws of the State of Colorado, United States.
